WSTLA Eagle Ben Barcus Obtains Justice for Family of 2-Year-Old
Ben Barcus handled the claim of a family who had left their two year old son in the care of a state-licensed daycare. Though the facility didn't have a fence around the yard and was close to a lake, the state twice issued licenses for the facility. Agency rules required the fence.
The verdict of $11.7M is largely symbolic, as nothing can replace the loss of a loved one. At the very least, it will result in better training of DSHS inspectors and better enforcement of its own rules, which are designed to prevent deaths and injury in the childcare industry. “They brought this action to make sure no other family has to go through what they went through,” Barcus said.
