Division III: Consent Under Current Consent Rules Adequate for Vehicle Search, Ferrier Not Extended to Cars
Cop: May I search your vehicle?
Cop: But I really want to search your vehicle, and its suspicious to me that you won’t allow it.
Always no. Every time, no. Never a yes.
Unless of course you’re this lady, who said yes. They asked permission and told her she had the right to stop or limit the search.
You can guess what they found.
She tried to argue a more stringent warning was required, pursuant to the Ferrier case. The court of appeals didn’t buy that, as Ferrier applies to knock and talk procedures in the home, not contact in car.
