Division II: Choice to Attend Mom's Surgery Instead of Ordered Appearance at Day 2 of Trial Leaves Conviction in Place
While you have a right to be in court, you also have the ability to waive that right. Here, Thereby chose to skip day 2 of trial to be with her mother. While that is not necessarily a poor choice, it is not a choice without consequences. The trial proceeded without her, and the court tentatively found no good cause for her absence. She was ordered to be in court, she chose not to.
