Division I: "He tried to kill me" by red-faced barely breathing man after the fact an excited utterance
This is a nice little criminal case, involving attempted second-degree murder. It also involves the merging of attempted second-degree murder and assault in the second degree. There is a nice little discussion about excited utterances, as well. Given that the court found it was an excited utterance, it of course ruled that there was no violation of the confrontation clause.
For you crim law junkies, there is not really anything new here.
