Division I: Crim. Defense Attorneys Need to Tell Client of Appeal Rights and Consequenses

State v. Chetty

Essentially, Chetty’s counsel didn’t inform him of the adverse consequences of not appearing, etc. How do we know this? It was asserted on the initial appeal, and sent back for fact-finding. What was really being asked for? An extension for the amount of time for filing the appeal. If you haven’t been informed, you can’t knowingly waive your right to appeal.
