Supreme Court Watch: No Surprise, Court Lukewarm to Tobacco Argument

The Supreme Court opened this term with oral arguments in Altria Group v. Good. In what should come as no surprise to those that follow the Roberts Court's decisions, the Court appeared cold towards arguments that state law did not preempt federal law in the case of tobacco manufacturers marketing cigarettes as light. The argument really hinges on the issue of whether the economic harms suffered in purchasing more light cigarettes are really intertwined with the health issues involved.
